Things to consider when requesting alimony

After a couple has decided to end their marriage and file for divorce, whether they are a civilian couple or military couple, it is common for one or both spouses to be frustrated and angry about the situation. Because of this anger, people may be difficult to talk with, making it difficult to resolve certain legal divorce matters.

For some couples, there are only a few things that need to be discussed, but for others, it may be necessary to figure out what will be done about their property as well as if one of them will be paying alimony.

When requesting alimony, spouses should consider the following:

  • Does your ex make enough money to afford alimony payments?
  • How long do you expect to receive alimony payments?
  • Are you able to maintain a similar lifestyle without alimony?

In some situations, people are simply requesting alimony because they are angry with their spouse. However, no matter what the reason is for this request, just because someone requests alimony from their spouse does not mean they will get it. If their spouse does not agree, then a judge will make the final decision and will review certain factors to help them determine if alimony is necessary.

Alimony is something to be requested if needed, not as a retaliatory move against an ex-spouse. In the end, it is up to the judge to decide whether an alimony request is valid and how much that amount will be. Anyone going through a divorce that has questions regarding alimony may want to speak with a knowledgeable divorce attorney.
