When is paternity assumed?

There are many children around the world who have been growing up without a father present. For that reason, it is especially important to allow a father to form a relationship with his child should he choose to be a part of his or her life. Unfortunately, even when fathers want to be present in the life of their children, they do not always get that chance. Oftentimes, before a father can start to form a relationship with his child he has to prove that he is, in fact, the father. However, there are certain situations in which paternity is assumed.

The following are situations in which paternity is assumed:

  • Couple signs an acknowledgment of paternity.
  • Couple marries and a legitimation form is signed following the birth of the child.
  • Couple is married prior to birth of child.
  • Man agrees to be named on child's birth certificate.
  • Man supports and cares for child as if it is his own.

While paternity is assumed in these situations and a father is allowed to spend time with his child, he still may not know for sure that he is the father. Should he decide to find out through paternity testing if he is the father of the child, he may do so. If all goes well, the child will be his and he can continue to care and build a quality relationship with the child.
